Execution decree of Jafar Kazemi political prisoner is endorsed

Jafar Kazemi’s lawyer said that his decree of execution has been endorsed at branch 36 of Revision Court of Tehran Province judged by Hojat Al Islam Zargar and request for judiciary restitution in branch 31 of the country’s Supreme Court has been denied.
Mr. Kazemi, 46, is a lithographer of educational and Amir Kabir Universitiy’s books. He was arrested on September 18, 2009 at Haft-e-Tir Square and was taken to solitary cells of ward 209 at Evin Prison and then transferred to ward 350 after 74 days.
He was also political prisoner from 1981 to early 1991.
Roodabeh Akbari his wife has written a letter to UN Secretary General asking for help in stopping her husband’s execution decree.
Ms. Qhanavi said about the charges: “Jafar Kazemi is accused of ‘Moharebe’ for supporting PMOI though he hasn’t accepted the charge in any of his interrogations”.
She added: “as Moharebe has root in canon law the accusation of Moharebe is amongst those crimes that the lawmaker must prove that it has had that condition including the fact that there has been an armed act. Most of Shiite experts believe that Mohareb is the one who uses arm.
This wasn’t my client’s case. He just participated in gatherings after the election and may be has chanted some slogans but as a lawyer I believe that the accusation of ‘Moharebe’ is not his case”.
About the defense at court she said: “unfortunately neither the primary court nor the revision court didn’t pay any attention to our defense and approved that he is a Mohareb”.
As Mr. Kazemi’s lawyer says ‘his decree is in the hands of the Branch for Execution of Decrees and legally nothing can be done to save his life”.

The Judiciary of clerical dictatorship handed over the execution decree of political prisoner Jafar Kazemi to the Branch of Execution of Decrees.
When his family referred to the different organs of the Judiciary they were not given a straight forward answer but the henchmen of the Security Interrogation of Evin Court have informed the family that his file has been sent to the Branch of Execution of Decrees and they are waiting his execution.
Jafar Kazemi political prisoner was imprisoned in 1980s accused of supporting PMOI and went under torture. Once again he was arrested in Fall of 2009 on the same accusation and because his son is in Ashraf City the place of resident of PMOI members in Iraq; he went under torture.
